What is a Gym Membership Agreement?

A gym membership agreement is the commercial contract between a fitness facility and the person joining it. It sets out the membership tier and what it grants access to, the dues and how they are billed, the length of the commitment, and the procedure for freezing, transferring or ending it. People routinely confuse this document with the liability waiver taped to the front counter, but the two answer different questions. The waiver deals with injury risk from using the equipment; the membership agreement deals with money, access and how the relationship ends — which is where the overwhelming majority of gym disputes actually begin.

Is a membership agreement the same thing as the gym's liability waiver?

No, and treating them as one document is a habit worth breaking. The membership agreement is commercial: dues, access, term, cancellation. The waiver is a release covering injury risk from equipment and facility use. Bundling both into one packet is common and perfectly workable, but keep the release as its own labeled section with its own signature rather than tucking it between the dues schedule and the parking rules. How long a term can I lock a member into?

That depends heavily on where you operate. Many U.S. states have health-club statutes that cap contract length — three years is a common ceiling and several states are stricter — require specific disclosures in a minimum type size, and sometimes require the facility to be bonded or to hold prepaid dues in escrow. A few restrict how much you may collect before the doors actually open. Check your state's health studio law before writing a five-year plan into your standard form. What does the cancellation section actually need to cover?

Four things, in language a member can act on without phoning reception. How they cancel — in writing, in person, by email — pick one method and honor it. How much notice is required before the next billing date. Whether any fee applies. And the statutory exits you must allow regardless of what your form says: most states let members cancel after relocating beyond a set distance, on a documented medical disability, or if the facility closes or materially changes what it offers. Many also give a short cooling-off window after signing, often three business days.

Do I need separate authorization to bill a member's card or account each month?

Treat recurring billing as its own consent rather than a sentence inside the dues paragraph. State the exact amount, the frequency, the day of the month, how much notice precedes a price change, and how the member revokes the authorization. Can someone under 18 sign a gym membership agreement?

Generally not on their own. Contracts with minors are typically voidable by the minor, so a parent or legal guardian signs and carries the payment obligation, and most facilities also set a minimum age for unsupervised floor access. Build the form with a guardian signature block and a line naming the responsible payer. If your gym admits teenagers with restrictions — no free weights unaccompanied, no access after a certain hour — write those into the access section instead of relying on staff memory.

How do I raise dues on existing members without losing the paper trail?
